Jury selection begins this morning in Blount County Circuit Court for the trial of a Maryville man charged in the death of a two-month-old girl in July 2010.
Michael Ryan Cody, 22, Howard School Road, was charged with criminally negligent homicide and was indicted by a Blount County grand jury on Aug. 8, 2011.
According to a Blount County Sheriff’s Office report, on July 17, 2010, deputies responded to a residence on Pea Ridge Road in Maryville in reference to the deceased child, who was found lying on a couch unresponsive.
The child’s mother, Latricia N. Luttrell, said she put the child in her crib at approximately 10:30 p.m. the night before, and she was lying on her left side when she put her to bed.
At 3 a.m. that morning, Luttrell went to her child’s bedroom to check on her and everything was fine. She later woke up and noticed it was 9:09 a.m., later than the child normally sleeps, according to the report.
Luttrell went into the bedroom and found the child lying on her back, unresponsive. She then took her into the living room and attempted to perform CPR. Paramedics with Rural/Metro checked the child for signs of life, but were not successful.
Cody was arrested without incident after the grand jury indictment was issued.
Judge David Duggan will preside over the trial. Blount County Assistant District Attorney Shari Tayloe is representing the state, while Maryville-based attorney George Waters will represent Cody.
