Judge Tammy Harrington has declared a mistrial in the case of a Maryville man who was accused of first-degree murder.

A jury found 25-year-old Sean Patrick Foley not guilty of first-degree murder late Friday afternoon, but were deadlocked on a lesser included charge of second-degree murder.

The prosecution and defense will determine a future course of action with a status hearing on Sept. 13.

I think he was wrong for shooting an unarmed man. The actions between Jimmy & Miranda was clearly consensual. I believe Miranda has some blame here though & should be charged. She obviously manipulated Sean & played the victim card with him making him think he was saving her. The prosecutors need to charge her as well.
